Understanding Property Division in Ontario
Under Ontario’s Family Law Act, married spouses are entitled to an equal share of the increase in value of their property acquired during the marriage. This process is known as the equalization of net family property (NFP). It does not apply to common-law couples in the same way.
Our Property Division Lawyers help you:
- Identify and value assets and liabilities
- Calculate each spouse’s net family property
- Address excluded assets such as inheritances or gifts
- Resolve disputes over property classification
- Negotiate or litigate fair settlements
What Is Net Family Property?
Net Family Property (NFP) is each spouse’s total assets on the date of separation, minus their debts and minus the value of assets they owned on the date of marriage (with some exceptions). The spouse with the higher NFP owes the other an equalization payment to achieve financial fairness.
Examples of assets included in NFP:
- The matrimonial home
- Bank accounts and investments
- Pensions and RRSPs
- Businesses or professional practices
- Vehicles, jewellery, or artwork
- Real estate and rental properties
We ensure every asset is properly disclosed, valued, and included in your final equalization calculation.
Property Division for Common-Law Couples
Unlike married spouses, common-law couples in Ontario do not have automatic rights to equal property division. Instead, a common-law partner may need to rely on:
- Trust claims (resulting or constructive trusts)
- Unjust enrichment arguments
- Agreements such as cohabitation contracts
If you are separating from a common-law relationship, speak with our Division of Property Lawyers to understand your options and protect what’s rightfully yours.
Excluded Property
Certain types of property may be excluded from equalization, such as:
- Gifts or inheritances received during the marriage
- Proceeds from personal injury settlements
- Property explicitly excluded by a domestic contract
However, these exclusions must be clearly traceable. Our lawyers help prove exclusions and ensure you retain assets that are legally protected from division.
