Understanding The Different Ways of Immigrating to Canada

If you are interested in immigrating to Canada, you could benefit from the support of an experienced immigration lawyer. Our lawyers at Prudent Law will explain the ways through which you can immigrate to Canada. We have best immigration lawyers who can also help you to apply for a residence permit depending on your needs, including applying to become a Canadian citizen.

Here are some of the current immigration programs that streams into Canada:

Express Entry

Express entry is one of the foremost ways to immigrate to Canada. This category accepts applicants through the following programs:

  • Federal Skilled Worker Program
  • Federal Skilled Trades Program
  • Canadian Experience Class

According to the latest Immigration Levels Plan, Canada plans to welcome around 83,000 Federal High Skilled Immigrants in 2023. This figure is expected to rise to 109,000 in 2024 and 114,000 in 2025. Many occupations qualify for express entry through the Federal Skilled Worker Program, including teaching assistants, nurses, truck drivers, payroll administrators and others.

Family Sponsorship for Citizens and Permanent Residents

Canadian citizens and permanent residents can sponsor the following family members:

  • Spouses
  • Partners
  • Children
  • Parents and grandparents

Partners and spouses can be of any gender, provided they meet the necessary requirements. As they wait for their application to be processed, spouses and partners can apply for a work permit. Children being sponsored must be below 22 years old and should not have a partner or spouse of their own. For a child above the age of 22 to qualify, they must be unable to support themselves financially because of a mental or physical disability. It should be evident that they depended on their parents for financial support even before they reached 22 years old.

Study Permits

Canada offers an established route for international students to acquire permanent residency. The students usually come in on a study permit or qualify for a post-graduation work permit that gives them the necessary experience to apply for immigration through Express Entry. However, while this pathway exists, applicants must be aware that it is highly competitive. Only a small fraction of the students studying in Canada end up becoming permanent residents.

You must meet the following requirements to qualify for a study permit:

  • You must have sufficient resources to support you while in Canada
  • You should have an acceptance letter from a recognized learning institution
  • You must not be criminally inadmissible
  • You should pass a medical examination if necessary
  • You must demonstrate that you intend to leave Canada after the expiration of your study permit

Work Permits

A temporary work permit can authorize you to work in Canada for a specified duration. Whether you qualify for a work permit will depend on several factors, including your education, work experience, employment needs in Canada and pilot programs. There are several types of work permits, including:

  • Open Work Permits – With this permit, you can work anywhere in Canada and for any employer. However, the permit can restrict you to work in a specific industry.
  • Closed Work Permits – With a closed work permit, you can work in Canada, but only in a specific location for a specific employer.
  • Post-Graduate Work Permit – This permit allows international students who graduated from recognized institutions in Canada to work and gain experience in their field.

Visitor Visas

Also known as a temporary resident visa, a visitor visa is granted to qualified people, allowing them to enter Canada as temporary residents. The three types of visitor visas are:

  • Single-entry visa
  • Multiple-entry visa
  • Super visa

Single-entry visas allow foreign nationals and temporary residents to enter Canada and stay there for a specified period.

Multiple entry visas allow temporary residents to re-enter Canada as many times as they like within a specified duration, like ten years. Every visit to Canada should not exceed six months.

A super visa works the same way as a multiple-entry visa. However, for each visit, you can stay in Canada for up to two years.

An applicant must demonstrate the following to qualify for a Canada Visa

  • Must have valid travel documents
  • Should have sufficient ties to the country of residence or home country
  • Should be in good health
  • Should have adequate funds to support them while in Canada
  • They should not be inadmissible to Canada
